DESCENDANTS OF JOHN D. GRAVES OF MD, KY & MO

GENERATION 1

John D. Graves (1) was born in 1776 in Maryland, and died about June 1848 in Franklin Co., KY. According to one source, he was of English origin. (That probably just means that some ancestor was from England, rather than that he or his father was born in England.) It goes on to say that he was raised in Virginia and went to Kentucky in his youth on foot. He had land in Lewis Co., MO as well as KY at the time of his death. (According to R‑4, he was John Downs Graves, born 24 Feb. 1773 in St. Johns Parish, Prince Georges Co., MD.) A Summons and Complaint is on record for a law suit in 1854-56 over the division of his estate. In this paper are references to some of his children: Susannah, Martha, Eliza, William L., Elias, and John T.

This John D. Graves may be the same as the one in genealogy 160 who is listed as a son of John Graves and Sarah Moab. That John Graves is believed by some to be a son of Peyton Graves and Charlotte Pinkard of genealogy 220, but no good evidence has been provided to support that connection.

John married four times. The second wife was Catherine Thomison. She was born in Scott Co., Ky., and died in 1827, possibly in Franklin Co., KY. He apparently married his third wife, Winnerford Hall, about 31 Jan. 1827 or 1828 in Franklin Co., KY. His fourth wife was probably Nancy ‑‑‑‑‑‑.

Following is a copy of a lawsuit by Joseph L. Graves, and 2 minors (his brothers?) George P. and Lewis S. Graves against Martha, etc. The best guess of Boyd Wright (R‑1) is that the children of John D. Graves by Nancy, the fourth (?) wife sued the children of John D. by Catherine Thomison over the division or administration of property. He has original copies of part of the suit, but hasn't found the remainder or how it came out.

The plaintiffs Joseph S. Graves, George P. Graves and Lewis S. Graves, the two last named infants under the age of twenty one years who Sue by the said Joseph S. Graves as their next friend state that John D. Graves late of Franklin County departed this life in said county on the --- day of --- 1848 having first made and published his last will and testament which was afterwards duly proved and admitted to record in the clerk's office of the Franklin County Court at June term of said court in the year 1848 by which he devised to his three daughters Susannah, Eliza, and Martha one horse saddle and bridle one bed and furniture and one Negro girl to each of them the same to be valued to them so as to make them equal also to said three daughters and to my son John Graves Six hundred and fifty acres of land in Lewis County Missouri being the lands owned by me over and above what I have given to my two sons William and Elias.

John to have two hundred acres and the remainder divided among the three daughters equally agreeably to quantity and quality that devised to the two Sons to be charged to them at one thousand dollars each the lands devised to the three daughters and son John to be charged to them at five dollars per acre. To Sarah Jones two hundred dollars, to Francis Smith one dollar. To Nancy Graves his wife the use of all his lands in Kentucky and all his personal estate after the death of his wife he directed the lands and personal estate bequeathed to his wife to be sold and divided among his second and last wife's children so as to make them all equal by counting in the legacies willed to the six before named children of his second wife and nominated the said Nancy Graves Executrix of his will. The executrix Nancy Graves named in said will never qualified as such nor was any administration of the estate of said dec'd. ever granted by the proper authority but contrary to what is the practice and usage in such cases the defendants took upon themselves to abrogate the will of said deceased in Several particulars by entering into an agreement among themselves by which a division of the estate was had and made in which agreement the directions contained in the will are violated in many respects and manifest injustice was done to these plaintiffs thereby as can be shown from the face of the agreement to divide and the division made they refer to and file copies of the agreement and division thus made as part hereof by the agreement and division so made it will be seen that the window Nancy Graves undertook to represent the interest of these plaintiffs in the matter and being wholly ignorant of even her own rights in the premises as well as theirs was duped as they verily believe into the agreement by her co-defendants in order that they should posses themselves of their shares of the estate. It will be Seen from the agreement entered into that all that part of the will of said deceased in relation to the lands in Missouri was disregarded. So far as the price at which the land devised was to be estimated and charged and the Sum at which it was charged in Said division is not more than half the sum fixed in the will. They further state that even if said division had been made in accordance with law and under the proper authority they Say the Same is unjust unequal and unfair in these particulars:

1st In the said division those making it and those concerned in it did not take into the estimate of what the estate consisted the amounts advanced to the Several devisees.

2. They did not bring into and estimate all the personal estate of said dec-d. and the debts due to the estate.

3rd. In the estimate for the division made the valuation put on the Slaves is entirely too low. For these errors and the wants of legality in said division and the manifest injustice done to these plffs in the premises they insist that said division shall not be allowed to stand. They further State that the Specific devise to Mrs. Jones and Mrs. Smith contained in said will have been paid by the defendants as they are informed believe and charge.

They call upon the defendants to produce and file a full and complete list of all the personal estate left by the Said John D. Graves also a list of all debts due the estate and a Statement Showing what disposition was made of it together with Such other information as will enable the court to ascertain in the true amount of estate real personal and mixed.

On hearing they pray that the Said division be set aside and the will of Said deceased carried out according to its true intent and meaning or if it be found impracticable to carry out the will and place the several devisees under the will in such condition as to enable each one to take and hold under and in accordance with the will of Said deceased then they pray that the defendants be decreed Severally to account for and pay to the plffs Such amount as will make up their just and equal Share of the estate they pray for all Such other and further relief as to equity belongs.

Graves and Elias Graves to answer in Sixty days after the Service of this summons of them, a petition filed against them etc. in the Franklin Circuit Court by Joseph S. Graves and others and was there that upon their failure to answer the petition will be taken due return of this Summons on the first day of the next May term of Said court.

John apparently had a total of 19 children.

John was a carpenter, and later a farmer. The wives and the children listed below are not all certain and are probably not complete. The children listed for his marriage to Nancy Poindexter are uncertain; the 1850 census for Franklin Co., KY lists children George and Lewis with mother Nancy (age 50 or 52) as head of family but with a Samuel Graves (age 48) also in the household, all born in KY. Richard B. Graves (2) was born about 1804 in VA. He was a farmer. He married Catherine ‑‑‑‑‑‑. She was born about 1810 in KY. He and his family were in the 1850 census for 48^th District, Lewis Co., MO, house 402, page 354. Catherine was in the 1860 census for Union, Lewis Co., MO, as head of household, so perhaps Richard had died. Catherine was in the 1870 census for Lewis Co., MO, as head of household, with children Lucy, Nannie, Kate and James. Eliza was born in KY, and all the other children were born in MO. (R‑4)

She was born 18 March 1821 in Lincoln Co., KY, and died 10 Aug. 1869 in Lewis Co., MO. He married second Lucinda Bruce, sister of his first wife. She was born about 1814 in KY. Living with them in 1850 was Susannah’s sister Martha. Their first 3 children were born in KY, and the fourth in VA.

Elias was in the 1880 census for Henderson, Henderson Co., KY, divorced, living with his unmarried son Richard. Nearby in 1880 was Eliza, divorced, living with her son Theodore. Eliza Graves (9) was born about 1820 in KY, and died 23 June 1853. She married William Epps Featherston (or Featherstone) on 15 Jan. 1846 in Franklin Co., KY. He was born 24 Nov. 1816 in KY, and died 1 Jan. 1878. They were in the 1850 census for District 2, Scott Co., KY. They were actually listed twice, once in house 287, page 466, 17 Aug. 1850, with him as age 33 and Eliza age 30, living next door to the family of James Featherston, age 59, probably his father. The second listing was in house 445, page 478, 26 Aug. 1850, with him as age 34 and Eliza age 29. Their son George was listed both times. (R‑4)

John T. Graves (10) was born about 1824 in KY. He first married Maria B. ‑‑‑‑‑‑. He married second Susan (“Susie”) C. Frazier. She was born about 1826 in Woodford Co., KY. They were in the 1880 census for Versailles, Woodford Co., KY (next to Franklin Co., where his father lived), page 441D. All his children were born in KY. In the 1850 census, there was a John T. Graves, 25, physician, and Maria B. Graves, 18 (maybe his sister, or wife), living with the family of Samuel Poindexter, 48, and Matilda Poindexter, 40, in Scott Co., KY, District 2, page 469, house 325. (Scott Co. is next to both Franklin Co. and Woodford Co.) This was probably this John, but that is not certain. Both his children were born in KY.

The following letter is believed to refer to this John T. Graves

Versailles, KY March 14, 1916

Dear Aunt Mary:

I am sorry that I am unable to give you much information concerning my Graves relatives. My father, John T. Graves died about 17 years ago. He was a brother of Aunt Martha Wright. I think Pa's sisters and brothers moved to Missouri when he was quite young, and I never knew of any communication existing between them until just a yr, or two previous to his death. Cousin Lloyd Featherstone died about 1 yr ago, he was an invalid yrs before his death, and I have been on the verge of invalidism for about 20 yrs. I don't know whether the old Graves house still remains or not. I regret I cannot give you more satisfactory information about my father's people, but this is about all I know of them. B. Graves of Scott County who died recently I don't think is related to us.

I have been trying to find out something about the family and after sending your letter to Mrs. Benham (the only relative near me) I enclose you what she wrote me. [ See above.]

I find the old home place is still standing in the same place but it had some additional built to it.

Am glad to tell you anything I know and am sorry I know no more to tell you.

The following is a letter from Sallie Featherston to "Dear Old Aunt" -- I believe it was to Martha Graves Wright. It is dated June ('85 or '95 -- unclear which, but clearly either 1885 or 1895). Sallie's husband Lloyd was a nephew of Martha Graves Wright, and, I believe the son of Eliza Graves who married W.E. Featherston.

You don't know how glad we were when we got Mrs. Isabell's letter telling us about you and your family. Mr. Fetherston didn't know that you was living, he knew he had two aunts in MO. but never had any body to tell him much about his Mother's kin. his Uncle John has told him more than any one, though he did not know whether you was living or not. I have not seen Uncle John (probably John T. Graves) since I heard from you. He has two children his daughter lives here I see her often she is married has one child a boy his son lives on Uncle's farm about 12 miles from here Uncle lives with him his uncles wife has been dead several years his health is poor and he looks badly and feeble. Lloyd is the only child living of his mothers, every body that knew her says he looks like her, he favors his uncle John very much I think he is now 46 years old I was a daughter of William Wilkinson. I have heard him speak very often of you and your father's family whom he knew and loved as well, I send you a picture of our family you can see what nice children we have the youngest is not good she is a very pretty child we never lost any children we do want one of your pictures be sure to send us one of Uncle's too I hope he will live to be one hundred years old, would like to have the pictures of your children and grandchildren also. I guess you remember Aunt Nancy Jones Fathers sister I was to see her last week is very feeble she is 83 years old she was glad to hear from you. Tell Uncle William (probably William Graves) to write to us , we would be more than glad to make you a visit but cant do so now if you cant come to see us send your daughter or sons we certainly appreciate a visit from any of you. My boys often speak of coming to Mo. and if they ever come will visit you up. Will close for the time hoping to hear from you soon and we are your loving nephew and niece.

Martha Catherine Graves (11) was born 20 Nov. 1825 in Frankfort, Franklin Co., Ky., and died 27 Dec. 1903 in LaBelle, Lewis Co., Mo. She married John Harvey Wright, son of John Wright and Ann Eliza Poague, on 16 Jan. 1854 in Lewis Co., Mo. He was born 2 March 1829 in Franklin Co., Ky., and died 17 Jan. 1901 in LaBelle, Mo. He was a farmer and stock raiser. Martha was in the 1850 census for 48^th district, Lewis Co., MO, house 256, page 341-342, living in the household of her brother-in-law and sister Joseph and Susanna Faulconer (Faulkner). They were in the 1880 census for LaBelle, Lewis Co., MO, page 148D, with all their children living at home, and all the sons working on the farm. Strangely, the census did not list the children as sons and daughters but gave their relationship as “other”. (R‑1)

Eliza Ann (or Sue) Graves (15) was born in May 1832 in KY, and died 21 July 1908 in WA. She married John Bourne Morton on 29 Jan. 1852 in Lewis Co., MO. He was born about 1830 in Jessamine, KY, and died in 1905 in Pullman, Whitman Co., WA. They were living in Oyster Bay, Lewis Co., MO on 1 July 1863, when he registered for the Civil War draft. They were in the 1860 census for Highland, Lewis Co., MO. They were in the 1870 census for Lewis Co., MO. They were in the 1880 census for Beaty, Carroll Co., MO. He was a farmer. All their children were born in MO. (R‑4)

Robert P. Graves (18) was born about 1840 in MO. He married Almira ‑‑‑‑‑‑. She was born about 1840 in MO or KY. They were in the 1870 census for Lewis Co., MO, living next to his mother. They were in the 1880 census for Ladore, Neosho Co., KS. All their children were born in MO except for the last one born in KS.

According to R‑4, Robert married Sallie E. Graves, who was born March 1861 in KY. That Robert Graves was in the 1900 census for Glenn Co., CA, married 7 years, with 3 children (2 probably by her first marriage and one, Mable, born July 1893 in MO). That may have been a second marriage for Robert P. Graves. However, it is puzzling that in 1900 he was living very close to Fountain C. Graves, born July 1828 in KY, with wife Levina J., and Henry F. Graves, born Aug. 1869, with wife Jessie M. Henry was a son of Fountain, and they were both part of genealogy 56. It seems likely that Robert was closely related to them; if so, this may be a different Robert.

Both her parents were born in KY. They were in the 1880 census for Lyon, Lewis Co., MO. They were in the 1900 census for Kirksville, Adair Co., MO, with children William, Lottie, Bessie, and Kate at home, and 5 of their 7 children still living. He was in the 1910 census for Kirksville, Adair Co., MO in 1910, widowed, with daughters Lottie and Bessie, and grandson Lloyd Young living with him. He was listed as a farmer in 1880, a dairyman in 1900, and a grocery merchant in 1910. All their children were born in MO.

Source R‑3 lists Anna Selena Graves as another child, possibly a twin of Ada, born July 1879 in Rea, Andrew Co., MO, died 22 Feb. 1949 in Aberdeen, Grays Harbor, WA. No evidence of any such child has been found. (R‑3)

You don't know how glad we were when we got Mrs. Isabell's letter telling us about you and your family. Mr. Fetherston didn't know that you was living, he knew he had two aunts in MO. but never had any body to tell him much about his Mother's kin. his Uncle John has told him more than any one, though he did not know whether you was living or not. I have not seen Uncle John (probably John T. Graves) since I heard from you. He has two children his daughter lives here I see her often she is married has one child a boy his son lives on Uncle's farm about 12 miles from here Uncle lives with him his uncles wife has been dead several years his health is poor and he looks badly and feeble. Lloyd is the only child living of his mothers, every body that knew her says he looks like her, he favors his uncle John very much I think he is now 46 years old I was a daughter of William Wilkinson. I have heard him speak very often of you and your father's family whom he knew and loved as well, I send you a picture of our family you can see what nice children we have the youngest is not good she is a very pretty child we never lost any children we do want one of your pictures be sure to send us one of Uncle's too I hope he will live to be one hundred years old, would like to have the pictures of your children and grandchildren also. I guess you remember Aunt Nancy Jones Fathers sister I was to see her last week is very feeble she is 83 years old she was glad to hear from you. Tell Uncle William (probably William Graves) to write to us, we would be more than glad to make you a visit but cant do so now if you cant come to see us send your daughter or sons we certainly appreciate a visit from any of you. My boys often speak of coming to Mo. and if they ever come will visit you up. Will close for the time hoping to hear from you soon and we are your loving nephew and niece.
